Terms and Conditions

These Terms and Conditions ("Terms") govern the use of the website powersportsengineering.com ("Website") and apply to all purchases made from RND Invest AB (trading as Powersports Engineering AB), registered in Sweden under organisation number SE556954542801, with registered address Pontonjärvägen 10, 961 43 Boden, Sweden ("we", "our", "us").

1. Scope of Sale

We sell physical goods under our own brand as well as selected third-party products. Our offerings are designed for consumers but are also available to approved business customers. We do not ship to PO boxes. Digital content or services are not offered.

2. Pricing, Taxes, and Duties

All prices on the Website are shown including VAT. We use the OSS/IOSS scheme for applicable intra-EU VAT reporting. Orders outside the EU may be subject to local duties and import taxes, which are the sole responsibility of the customer. We do not cover or refund these charges.

3. Payment Terms

We accept the following, but not limited to, payment methods:

Business customers may also pay via credit card or bank transfer. No installment payments are offered. For overdue B2B invoices, we reserve the right to charge interest at 8%.

4. Shipping

Orders are typically processed within 1–2 business days. Estimated delivery times:

- Within EU: 4–8 business days

- Outside EU: 6–12 business days

Shipping carriers vary depending on location and are managed via our 3PL partner. Orders over €100 within the EU qualify for free shipping. Customers outside the EU do not qualify for free shipping.

We are not liable for delays, losses, or damages caused by the shipping carrier. Responsibility for the shipment transfers to the customer upon dispatch.

5. Right of Withdrawal and Returns (Consumers Only)

Consumers within the EU have the right to withdraw from a purchase within 14 days of receiving the goods.

To qualify, the product must be unused, in new condition, and returned in its original packaging. The right of withdrawal does not apply to:

- Custom-made or personalized products

- Products that have been installed, used, or show signs of wear

- Sealed items that have been opened and cannot be returned for hygiene or functional reasons

To initiate a return, notify us in writing within 14 days of delivery. You are responsible for return shipping, and the item must be received within 14 days of your cancellation notice. Refunds are issued within 14 days of receiving the item, subject to inspection.

As an EU-based company, we adhere to the Online Dispute Resolution (ODR) platform provided by the European Commission. In case of disputes relating to online purchases, consumers may contact the ODR platform here:

6. Business Customers (B2B)

All B2B sales are final unless otherwise agreed in writing. Returns are not accepted without prior written approval and may be subject to a restocking fee. Credit terms and resale pricing guidelines (MAP/MSRP) must be followed as contractually agreed.

7. Warranty and Complaints

We follow Swedish law (Konsumentköplagen) including the 3-year reklamationsrätt for consumers. Manufacturer warranties may vary by product.

Warranty claims are processed within 10–14 business days and may result in repair, replacement, or refund, depending on product and fault. Claims for defects or transit damage must be submitted in writing with documentation.

8. Limitation of Liability

All products must be used and installed in accordance with their instructions. We are not liable for damages caused by misuse, third-party modification, or incorrect installation. Our total liability shall be limited to the purchase price of the product in question.

9. Intellectual Property

All content on the Website, including product designs, logos, text, and images, is the intellectual property of Powersports Engineering AB or its partners. Reproduction, distribution, or use without prior written consent is strictly prohibited.

10. Customer Accounts and Data

Customers may create accounts to manage orders and preferences. We reserve the right to suspend or terminate accounts if misuse is suspected. Data is collected for order processing, customer service, analytics, and marketing in accordance with our Privacy Policy.

11. Force Majeure

We shall not be held liable for failure or delay in fulfilling our obligations due to events beyond our control, including but not limited to natural disasters, war, pandemics, strikes, government action, or failure of suppliers.

12. Governing Law and Jurisdiction

These Terms are governed by Swedish law. Any disputes shall be resolved by a Swedish court with appropriate jurisdiction.

13. Promotions and Resale

Discount codes or promotional offers may be subject to specific conditions and time limits. We allow the resale of our products under approved dealer terms. B2B customers must follow any applicable MAP or MSRP guidelines in accordance with legal regulations.
