These Terms of Service ("Terms") apply to all purchases and use of the website powersportsengineering.com ("Website"). The Website is operated by RND Invest AB (trading as Powersports Engineering / PSE) ("we", "us", "our").

2) Scope

We sell physical goods under our own brands and selected third-party products. Unless explicitly stated, we do not sell digital content or services. We may restrict shipping to certain destinations and we do not ship to PO boxes where carriers cannot deliver.

3) Prices, VAT, and duties

Prices shown on the Website are shown including VAT where applicable for consumer sales within the EU/EEA/UK. We may use OSS/IOSS or other legally compliant VAT mechanisms where applicable.

Orders shipped outside the EU/EEA/UK may be subject to import duties, taxes, or customs fees charged by local authorities. These charges are the customer’s responsibility and are not refunded by us. We do not under-declare values or mark shipments as "gift".

4) Payments

We offer payment methods displayed at checkout (which may include card schemes and digital wallets such as Visa, Mastercard, American Express, Apple Pay, Google Pay, and other local methods). Available methods may vary by country and order value.

For B2B customers, payment by bank transfer may be offered by agreement. No instalment payments are offered unless explicitly stated at checkout. For overdue B2B invoices, statutory interest and reminder fees may apply.

5) Orders and stock availability

All orders are subject to acceptance and stock availability. We try to maintain accurate stock levels, but occasional discrepancies can occur. If we cannot fulfil an item, we will contact you with options (partial shipment, wait for restock, or refund for the unavailable item).

6) Shipping and delivery

Processing times are stated in our Shipping Policy. Delivery times are estimates and not guarantees. Tracking information is provided where available.

Consumer risk: For consumer purchases, the risk of loss or damage normally transfers to you when you (or someone on your behalf) receive the goods, unless mandatory law states otherwise.

Business risk: For B2B shipments, risk transfer may differ and can be agreed in writing.

7) Right of withdrawal (consumers only)

Consumers in the EU/EEA/UK normally have a 14-day right of withdrawal for distance purchases. Details and instructions are set out in our Return & Refund Policy, which forms part of these Terms.

8) B2B orders

B2B sales are final unless otherwise agreed in writing. Returns are not accepted without prior written approval and may be subject to a restocking fee.

9) Warranty, complaints, and consumer rights

We follow applicable Swedish consumer law for consumer purchases, including the right to make complaints about defects within the legally applicable period (commonly up to 3 years for consumers in Sweden, depending on circumstances).

If you believe an item is defective, contact returns@powersportsengineering.com with your order number and documentation. We may offer repair, replacement, or refund depending on the case and applicable law.

10) Product use and limitation of liability

Products must be installed and used according to provided instructions and intended use. We are not liable for damage caused by misuse, incorrect installation, third-party modification, or use outside intended applications.

To the maximum extent permitted by law, our total liability is limited to the amount paid for the specific product giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under mandatory law.

11) Intellectual property

All content on the Website (including designs, text, images, logos, and product designs) is owned by us or our licensors and is protected by intellectual property laws. You may not copy, reproduce, or distribute it without prior written permission.

12) Customer accounts

If you create an account, you are responsible for maintaining the confidentiality of your login details and for activities under your account. We may suspend or terminate accounts if misuse or fraud is suspected.

13) Force majeure

We are not responsible for failure or delay caused by events beyond our reasonable control, including but not limited to carrier disruptions, supplier failures, natural disasters, war, government actions, strikes, or outages.

14) Governing law and disputes

These Terms are governed by Swedish law. If you are a consumer, mandatory consumer protection rules in your country of residence may also apply and are not affected by these Terms.
